What if you could prepare the jury for an evasive witness before the witness ever takes the stand?

That’s what Keith Mitnik does.

When he expects a witness to dodge difficult questions, he gives the jury something to watch for:

Are they answering directly?

Avoiding the question?

Adding a “but” to explain why their side is still right?

Then the jury can judge the witness’s credibility for themselves.

Your job is to prepare the jury, then let the witness show them who they are.

Hear Keith and Jennifer Rosinski’s full approach to cross-examination in the latest episode of The Art of Outsmarting, airing on October 21st at 12 PM EST.

Verdict Alert 🔊

The verdict: $18,874,851.68

A Jacksonville dad didn’t settle for less.

And now, more than two years after his crash, a jury has awarded him $18.9 million — nearly 95 times the initial settlement offer.

The active father was in stopped traffic when he was rear-ended on I-275, resulting in facet injuries and herniated discs in his mid and lower back. He continues to undergo extensive treatment for his ongoing pain.

Despite this evidence, the defense attempted to minimize his injuries with only a $200,000 pretrial offer.

Represented by Morgan & Morgan attorneys Dustin Middleton, Eric (Rick) Block, Andrew Paladino, and Grayson Wallace, the plaintiff rejected the settlement before his legal team took the case to trial and secured the 8-figure verdict.

“The jury recognized how deeply this crash has affected our client and the life he had before his injuries,” said attorney Dustin Middleton. “Since the crash, he has had to give up many of the activities he loved and has lost treasured ways to connect with his youngest daughter. We’re grateful to the jury for… providing him with meaningful compensation for what he has lost.”

Give jurors enough context to understand why you’re asking the question.

In the next episode of The Art of Outsmarting, on October 21st at 12 PM EST, renowned trial attorneys Keith Mitnik and Jennifer Rosinski break down how to:

- Give jurors context without losing control of the cross
- Use questions to expose the reasoning behind a witness’ conclusions
- Keep the jury focused on why an admission matters
- Build your case while you cross-examine

Because a jury can hear the right answer and still miss the point.

Tune in for the full CLE-accredited episode, then stick around for the live Q&A.

“I won the witness, but did I win the jury?”

Keith Mitnik learned that lesson the hard way.

A string of perfect admissions and clean impeachments can feel like a victory, but if the jury doesn’t understand how those points advance your case, what have you really accomplished?

The question Keith asks now: What do I need to accomplish with this witness?

That answer should shape the cross.

Verdict Alert 🔊
The verdict: $1,820,000

A T-bone impact.
Lasting lower body pain.
And a $1.8 million verdict.
After a 2024 accident left a mother with hip and joint injuries, impacting her ability to take care of her children and her home, Morgan & Morgan attorneys fought to gain recognition of her pain — and a verdict that matched her injuries.
The defense’s pre-trial offer of $250,000 was rejected before her legal team — attorneys Angela Agostino, Jennifer Rosinski, and Jason Gelinas — secured a win more than seven times that amount.
“This case was about showing the jury how significantly this crash changed our client’s life,” said Agostino. “Prior to the crash, she was an active mother and member of her community, but she now moves with a guarded gait and struggles with daily normal activities. The defense tried to blame her for the crash and minimize her injuries, but the evidence spoke for itself.”
