If you’re facing foreclosure, you may hear people say, “Just file bankruptcy.”
It’s not quite that simple.
Chapter 7 and Chapter 13 work differently, especially when a home and past-due mortgage payments are involved.
Chapter 7 may temporarily pause a foreclosure, but it generally doesn’t give you a long-term repayment plan for catching up on missed mortgage payments.
Chapter 13 may give an eligible homeowner a way to address those past-due payments through a repayment plan while continuing to make regular mortgage payments.
Which one makes sense, if either one does, depends on your situation.
