On December 19, 2025, Wise Law LLC filed a SECOND collective and class action lawsuit against Red Robin, alleging violations of the FLSA that would give salaried and hourly Managers overtime backpay and backpay of the tips they had earned - which the lawsuit alleges Red Robin either kept or shifted to another worker.

This lawsuit seeks to cover ALL former and current salaried and hourly Managers at Red Robin since September 29, 2022 - in all states across the nation.

On September 10, 2025, Wise Law LLC filed a collective and class action lawsuit against Red Robin International, Inc. alleging violations of the Illinois Wage Payment and Collection Act. Plaintiffs allege Red Robin failed to reimburse employee expenses, such as use of their personal vehicles to deliver catering and obtain supplies from other locations. Plaintiffs also allege Red Robin prohibited Salaried and Hourly Managers from keeping tips / gratuities they earned.

On September 10, 2025, Wise Law LLC filed a collective and class action lawsuit against Red Robin International, Inc. alleging unpaid overtime violations under the FLSA, the Illinois Minimum Wage Law, and the Missouri Minimum Wage Law. Plaintiffs allege Red Robin misclassified Assistant Managers, Kitchen Managers, and General Managers as exempt from overtime, but required them to work long hours performing non-managerial, physically demanding tasks, such as cooking and cleaning, without overtime pay.

WHAT DO YOU MEAN, I CAN'T SUE IN COURT!?

If a consumer and a business/organization have entered into a contract to have their disputes resolved by "binding arbitration," an individual who files a lawsuit in state/federal court will likely face a "Motion to Compel Arbitration" from the business/organization.

A Motion to Compel Arbitration is essentially the business/organization asking the court to require the individual to take their dispute to "arbitration," rather than the lawsuit proceeding in court. NOTE - court documents are often public, while arbitration documents are often not public.

Now, these arbitration clauses often can be - and are - challenged by the individual, which can result in an individual's lawsuit continuing in court, rather than in a non-public arbitration arena.
