What’s Important Now (W.I.N.)

Today, our community experienced a tragedy at the Fayette County Courthouse. A life was lost, and regardless of the circumstances surrounding any criminal case, that loss is heartbreaking.

As someone who has spent years in law enforcement, criminal investigations, and the legal system, I have seen firsthand how overwhelming it can feel when a person finds themselves facing criminal charges. The fear, uncertainty, embarrassment, financial strain, and concern for family can become all-consuming.

If you are currently facing charges, or if someone you love is, I want you to remember something important:

You are innocent until proven guilty.

And even if a conviction occurs, life does not end there.

Every day, people overcome mistakes, rebuild relationships, restore their reputations, strengthen their faith, and create meaningful futures. Courts hand down sentences; they do not determine your worth as a human being.

When life feels overwhelming, focus on what is important now — W.I.N.

Think about your family.

Think about your children.

Think about your friends.

Think about the people who would answer the phone if you called.

Think about your faith.

Think about tomorrow.

Most importantly, understand that the emotions you are feeling today are temporary, even when they seem permanent.

CASE DISMISSED – NOLLE PROSEQUI

Our client was arrested and charged with Felony Fleeing and Eluding after deputies alleged he was the rider of a motorcycle that fled from law enforcement. After losing sight of the motorcycle for an extended period, deputies searched nearby neighborhoods and ultimately arrested our client at his girlfriend’s residence, relying on circumstantial observations and assumptions to support the arrest.

During our investigation, Lerner Consulting obtained Ring camera footage confirming our client had not left the residence for more than eight hours prior to the incident. We also conducted a detailed comparison of the motorcycle seen in the patrol vehicle’s dash camera footage and our client’s motorcycle. The headlights alone revealed a critical inconsistency—one displayed three distinct circular lights while the other featured a diamond-shaped configuration.

The evidence simply did not support the allegations. After a thorough review, the State entered a Nolle Prosequi, and our client walked away without a conviction.

This case serves as an important reminder: an arrest is not proof of guilt. Michael is a military veteran, law student, and career investigator with nearly two decades of experience in local, state, and federal criminal investigations. Throughout his career, he has served as a DEA Task Force Officer, undercover narcotics investigator, supervisor, and K9 handler, working complex cases involving drug trafficking and organized crime. Most recently, Michael served as a Criminal Investigator with the Georgia Public Defender Council, giving him valuable insight into criminal litigation from both the prosecution and defense perspectives.

As he continues pursuing his J.D. at Atlanta’s John Marshall Law School, Michael brings a wealth of investigative knowledge, real-world experience, and a genuine commitment to justice. Lerner Consulting LLC grabbed another Nol. Pros. This one was in Coweta County, GA. There is nothing greater than watching an innocent person walking out of the courthouse with their attorney!

After a careful review and analysis of the case file and available evidence, Lerner Consulting identified a critical issue: the State did not appear to have sufficient evidence to support a conviction.

The case relied heavily on assumptions rather than verified facts. Those assumptions could not be confirmed at the scene, and more importantly, they would have been difficult, if not impossible, to prove in a courtroom.

Through a detailed review of the evidence, Lerner Consulting was able to highlight the weaknesses in the State’s case and assist in bringing those concerns forward.
