Immigration filings leave little room for preventable errors. Missing evidence, inconsistencies, outdated forms, incorrect filing fees, or overlooked requirements can lead to delays, Requests for Evidence (RFEs), and in some cases, denials.

Join Partner and Attorney Kirti Kalra and Client Services Manager Arianna Gonzalez on Thursday, September 24th at 11:00 AM PST / 2:00 PM EST for an informative discussion on how individuals and employers can prepare stronger immigration filings from the start.

During this session, we will discuss common issues that can trigger RFEs, the importance of establishing eligibility at the time of filing, how to identify inconsistencies across immigration records, and practical steps for ensuring forms, fees, signatures, and supporting documentation are complete and accurate. We will also cover strategies for responding effectively when an RFE is issued.

Whether you are an employer managing immigration matters or an individual navigating the immigration process, this session will provide practical insights to help reduce avoidable delays and strengthen your filings.

How significant could the proposed fee be for employers that hire multiple H1B workers?

The financial impact could be substantial, particularly for employers that sponsor multiple cap-subject H-1B workers.

With up to 85,000 cap-subject H-1B visas available annually, a proposed fee of $103,265 per petition could translate into approximately $8.78 billion if applied across all 85,000 cap numbers.

For employers filing multiple cap-subject H-1B petitions, these costs could add up quickly. If the proposal is finalized, employers would need to carefully consider the potential financial impact as part of their H-1B cap planning and workforce strategies.

Why the government is proposing such a large H-1B fee?

DHS describes the proposal as a way to recover a portion of the federal government’s costs associated with administering the immigration system.

Rather than setting the fee solely based on the cost of processing an individual H-1B petition, DHS is proposing to use cap-subject H-1B filings as a mechanism to help fund broader immigration-related government costs.
