Aggravated DWI is a more serious DWI charge in New York based on a higher BAC.
A regular DWI can apply at 0.08% or higher. Aggravated DWI usually applies at 0.18% or higher, which is more than twice the legal limit.
That higher number can lead to tougher penalties, license consequences, and more pressure in court. Before you respond to the charge, make sure you know exactly what level of DWI you are facing.
