South Carolina has a unique real estate and estate planning landscape deeply tied to its history, particularly regarding Heirs' Property—family land passed down through generations without a formal will, common in Lowcountry and rural communities.

The Challenge: Passing property without a clear will leaves land owned by dozens of co-heirs, leaving it vulnerable to forced partition sales by outside developers.

The SC Tool: To combat this, South Carolina enacted the Clementa C. Pinckney Uniform Partition of Heirs Property Act.

How It Works: This unique statutory tool gives co-tenants procedural protections, including the right of first refusal to buy out a co-owner’s share before a court can force a public sale on the courthouse steps.

Proactive Planning: Pair this statutory protection with a South Carolina Revocable Living Trust or an LLC to consolidate land ownership, establish clear title, and preserve family wealth across generations.
