What is an Antenuptial agreement, and do I need one?

An antenuptial agreement (or a prenuptial agreement) is an agreement made between two individuals before getting married, to permit them to individually retain certain assets during the marriage and after the marriage should divorce arise.

Prenuptial agreements are seen most often in two scenarios:
-Second marriages of older individuals who already have children
-Couples where one party is bringing large amounts of property or assets into the marriage
That is not to say that these are the only situations where individuals enter into a antenuptial agreement.

If you have questions, about the necessity of or process in creating an antenuptial agreement, you should speak with an attorney skilled in both family and estate planning law to assist in determining if one is needed and how best to create a binding agreement.
