What Are Common Traffic Related Offenses That Your Firm Handles?

Most commonly, people call me when they have been written up for a speeding ticket or a DWI. There are 62 counties in the state of New York and I’ve represented people in virtually every county on some vehicular offense or another. Depending upon how distant the geographic area, I may not personally appear, but can help to defend any traffic ticket matter from start to finish throughout the entire state of New York. The majority of cases that come to me are from Westchester, Putnam, Orange, Dutchess, and Rockland Counties. For these five counties, I typically personally appear. Otherwise, I have very experienced associate counsel appear on my firm’s behalf further up north.

Are There Alternative Programs Available For First Time DWI Offenders?

The New York state statute, which applies across the entire state, prohibits reducing a DWI charge beyond a DWAI (for example, no “reckless driving” alternative plea.) Not all DWI charges may be resolved by negotiation if the BAC is too high or some other aggravating factor exists – these cases may have to go to trial before a judge or jury. It’s important to note that it is not entirely uncommon for some people to be arrested for DWAI in the first instance. They would have allegedly failed the arresting officer’s observations of intoxication and when they got brought to the station, they blew a 0.07 and weren’t charged with DWI – so, they are charged with DWAI at the outset. There’s typically no bargained for reduction from that charge because it is already the lowest charge in the statute of alcohol related offenses.

How Does A DWI Arrest Generally Occur In New York?

DWI stands for driving while intoxicated and basically means that a motorist is incapable of having the physical and mental abilities required to possess (or, impaired to a substantial extent) as a reasonable and prudent driver. Other states call it DUI or driving under the influence. I want to point out that a lesser degree of impairment in New York is a DWAI or driving while ability impaired. DWAI is a violation, not a crime like DWI is. The court of appeals, which is the highest court in New York, has defined a DWAI as a motorist’s physical or mental abilities actually being impaired (i.e., diminished or reduced) to any extent.
