"Do I need a will or a trust?" It's one of the most common questions families have when they start thinking about estate planning, and the answer is not the same for everyone.

Most people feel a quiet sense of relief once their estate planning documents are signed. That feeling makes sense. Getting a plan in place is a real step forward.

The problem is that signing the documents is not the same as having a plan that actually works.

In Alabama and Florida, some of the most common estate planning mistakes have nothing to do with the quality of the original documents. They happen when life changes and the plan does not. A fiduciary who can no longer serve. A beneficiary designation that was never updated after a divorce. A trust that was drafted but never funded.

We wrapped up our May estate planning seminars in Mobile this week, and it is always worth pausing to reflect on what makes these evenings meaningful.

It was the people who showed up. Families thinking seriously about the future. Parents who want to make sure their kids are protected. People caring for aging parents while managing everything else life throws at them. Folks who simply want to understand how this process works before they are forced to figure it out under pressure. That kind of care and curiosity makes every conversation in the room better.

That is exactly why we do this work. Estate planning is not just about documents. It is about making sure the right people have the right authority at the right time. Getting that wrong has real consequences. Getting it right brings real peace of mind.

Jerusalem Café took wonderful care of us, and the food was the kind you are still thinking about on the drive home.

Most people who delay estate planning are not being careless. They look at their family, see people who genuinely love one another, and assume things will work themselves out.
That assumption is understandable. Under Alabama law, it is also incomplete.

Alabama law does not distribute property based on relationships or good intentions. It follows a legal framework. When no plan exists, that framework fills in the gaps, and the results may have nothing to do with what someone actually wanted.

Even in close families, the absence of clear documentation can create real confusion. Not because anyone is greedy or dishonest, but because grief is complicated, interpretations differ, and the law requires certainty that good intentions cannot provide.
