🚨 IMMIGRATION ALERT: New U.S. Visa Restriction Policy on Birth Tourism

The U.S. Department of State has announced a new visa restriction policy aimed at individuals who knowingly engage in or facilitate birth tourism to the United States.

The announcement specifically refers to commercial birth tourism networks, visa “fixers,” certain foreign medical providers, and others who support or enable these activities. It also states that certain family members may be covered by the restrictions.

⚠️ For visa applicants, this is another reminder that the information provided in a U.S. visa application matters.

❌ Do not rely on anyone who tells you to hide information, misrepresent facts, or “work around” the rules.

✅ If you are planning to apply for a U.S. visa and have questions about how the rules may apply to your situation, get informed before you apply.

📲 Contact Immigration Law USA Solutions to schedule a consultation and understand your options before taking the next step.

🚨 IMPORTANT VISA UPDATE

The U.S. Department of State has issued new guidance regarding the resumption of certain Immigrant Visa and Diversity Visa processing affected by previous visa issuance pauses.

If your case was placed on hold or refused under 221(g) because of one of these pauses, your case may now need to be reviewed under the regular consular process.

⚠️ Important: This does not mean automatic visa approval. Applicants must still meet all applicable eligibility requirements.

📌 For DV-2026 applicants, timing is especially important because the fiscal year ends on September 30, 2026.

If you believe your case may be affected, contact our team to discuss your situation.

🚨 **ATTENTION: New Public Charge Rule Is Now in Effect! 🇺🇸**

As of **September 18, 2026**, the U.S. Department of Homeland Security has implemented a new approach to the **Public Charge** determination in certain immigration cases.

The new rule gives immigration officers broader discretion to consider an applicant’s **financial circumstances and overall situation**, including factors such as:

🔹 Household income and financial resources
🔹 Use of certain means-tested public benefits
🔹 Age, education, skills, and other relevant factors
🔹 The applicant’s overall circumstances

⚠️ **Important:** Receiving a public benefit does **not automatically mean** that an individual will be denied a visa or Green Card. Public Charge determinations are made based on the totality of the circumstances and depend on the specific case.

If you are applying for a **Green Card, adjustment of status, or an immigrant visa**, it is important to understand how this change may affect your case.

✔️ Restrict certain school transfers and major changes
✔️ Limit multiple degrees at the same education level
✔️ Set new limits for English language programs

⚠️ These changes are NOT in effect yet. They are currently scheduled to take effect on September 15, 2026, although DHS may postpone implementation.

⚖️ USCIS has issued a new memorandum regarding Adjustment of Status applications.

While the agency is emphasizing closer review of each case, this is not a blanket denial policy. Applicants who qualify for permanent residence may still be approved, especially when their cases are well-prepared and supported by strong evidence.

Positive factors such as family ties, employment history, good moral character, and community involvement remain important.

The key takeaway: preparation matters more than ever.

If you have questions about how this policy may affect your case, contact our office today.
