🇭🇹 IMPORTANT UPDATE FOR HAITIAN TPS HOLDERS 🇭🇹

If you have Temporary Protected Status (TPS) under Haiti, please read and share this.

As of July 1, 2026, TPS for Haiti has NOT ended. A federal court order is keeping the protection in place, which means:
✅ You keep your TPS and your work authorization.
✅ Your documents remain valid under the court order.
✅ Your EAD (Form I-766, category A12 or C19) is extended. Government records currently show work authorization through the July 10, 2026 EAD expiration date.

⚠️ Please understand: this is temporary relief. The case (Miot v. Trump, filed in the U.S. District Court in Washington, D.C.) is still in active litigation, and your status could change depending on how the courts rule. That's why it's so important to stay informed and get advice about your specific situation.
Don't panic, but don't ignore it either. If your EAD is expiring soon, or you're unsure how this affects you, let's talk before you make any decisions about work or travel.

This one matters, so let me explain why.
What is habeas corpus?

"Habeas corpus" is Latin for "you shall have the body." It's one of the oldest and most powerful protections in our legal system, often called the "Great Writ." In plain terms, it's a legal action that forces the government to justify why it is holding someone in custody. If the detention is unlawful, a federal judge has the power to order that person released.
Why is it such a big deal?

In the immigration context, people can be held in detention for weeks, months, or even longer, sometimes without a meaningful chance to challenge it. A habeas petition takes that question directly to a federal court and says: prove this detention is lawful, or let our client go. It's a constitutional check on government power, a safeguard that traces all the way back to the foundations of due process.

He is now a Lawful PERMANENT resident!!

He was detained by ICE but Because he was an arriving alien he was subject to mandatory detention, he wasn’t eligible for bond. Instead, he spent months detained in a Louisiana ICE detention center waiting for his individual (final) hearing.

He came to the United States when he was just 8 years old. This is the only country he has ever truly called home. Yet, after years of building his life here, he was being told he had to leave everything behind. Not because of his criminal conviction as it was not something that made him ineligible for permanent residence, but because he had overstayed his visa.

Several immigration attorneys told him his best option was to accept voluntary departure and leave the United States. I remember telling his wife to tell him to hold on.

The judge granted his greencard application, a judge who denies 90% of cases that come before him. We fought hard! After it was granted we had another fight! ICE refused to release him!! They had no grounds for an appeal but still they held on to him until the appeal period had lapsed and it took several strongly worded emails to secure his release.

My client walked into that detention center as a DACA recipient who believed all hope was lost.

He walked out as a lawful permanent resident.

A green card holder.

Cases that appear impossible often aren’t. Sometimes the difference isn’t the facts, it’s having someone willing to fight for every legal avenue available.
