YOUR ASYLUM CASE MAY BE YEARS OLD. IS YOUR EVIDENCE?

If your I-589 asylum application has been sitting with USCIS for years, you may have changed significantly since the day you filed it.

Now, many applicants are seeing a new message in their USCIS accounts: “Next Step Is Adjudication” instead of “Next Step Is an Interview.”

That does not automatically mean your asylum case has been approved or denied. But it could mean that the government is reviewing your file in a different way.

And that raises an important question:

What exactly is in your asylum file?

I-751 APPROVED IN EIGHT MONTHS!

For many conditional permanent residents, Form I-751, Petition to Remove Conditions on Residence, can feel like a long and uncertain part of the green card process.

USCIS can request additional evidence, issue a Notice of Intent to Deny, or take a significant amount of time to make a decision. That is why an I-751 approval in less than eight months was such exciting news for Blandon Law and our client.

If you received your green card through marriage to a U.S. citizen or permanent resident before your second wedding anniversary, your residence may have been granted on a conditional basis. In that situation, you generally need to file Form I-751 during the 90-day period before your conditional green card expires.

Could you have an immigration court case and not know it?

If you filed an I-589 asylum application years ago, moved to a new address, and have been waiting for USCIS to schedule your asylum interview or decide your case, a new Board of Immigration Appeals decision deserves your attention.

On September 3, 2026, the BIA issued Matter of DIJI, overruling an earlier decision that had provided protections for certain immigrants who had not received the Notice to Appear that initiated their immigration court proceedings.

The case involved an immigrant who moved in 2019. DHS later sent his Notice to Appear to his former address.

Understanding your current immigration status may be critical.

Legal Immigration Under Pressure. Your immigrant visa is more than a piece of paper. For many families, it is the final step toward living together permanently in the United States.

The immigrant visa system was established through laws passed by Congress. Today, however, immigration policies coming from the executive branch are creating uncertainty for people around the world who are following the legal immigration process.

Federal courts have repeatedly been asked to review policies affecting legal immigration, including refugee admissions, diversity visas, birthright citizenship, asylum, and work permits.

A federal judge in Dorcas v. USCIS ruled that four policies freezing certain immigration benefits, including asylum, work permits, adjustment of status green cards, and citizenship applications, were illegal.

So, what does that mean for the millions of people whose cases were placed on hold?

USCIS may now be required to resume making decisions. But that does not necessarily mean decisions will arrive immediately. The government may appeal the ruling or request a stay, which could keep cases frozen. Even if there is no appeal, USCIS officers may need to receive new instructions before they can begin processing affected cases.

For immigrants from the 39 affected countries, this is an important development, but your case may still require careful monitoring.

Is It Worth Paying a Naturalization Attorney by the Hour?

Why pay an immigration attorney by the hour when experience and technology can make the process more efficient?

At Blandon Law, naturalization applications are handled for a flat fee, so you know what you are paying regardless of whether your attorney needs to speak with you three times or thirteen times before filing.

But the value of an experienced naturalization attorney goes far beyond completing Form N-400.

During your citizenship process, seemingly small details can become major problems.

New immigration policies are making VAWA green card cases more challenging than ever. USCIS is now looking beyond proof of abuse and may also examine the intent and pattern behind an abuser's actions.

Building a strong VAWA case requires more than completing forms. Every detail, supporting document, and personal statement must work together to clearly present your case. If you've experienced abuse by a U.S. citizen or lawful permanent resident spouse, parent, or child, experienced legal guidance can make a significant difference.

What happens when an immigration judge says you should be safe in another country, even though you have never lived there?

For some asylum seekers, the government may argue that they could have sought protection in another country before arriving in the United States. These arguments can become especially important when the government invokes safe third country policies.

But simply travelling through a country does not necessarily mean that country was a realistic or safe place to seek asylum. An applicant may have faced criminal threats, detention, lack of protection, or other circumstances that made it impossible to seek safety there.

Blandon Law attorneys have successfully defended asylum applicants against these arguments. In one case, the government argued that a Venezuelan applicant should have sought asylum in Guatemala or Honduras. Our attorneys explained why the applicant's circumstances meant that asylum was not realistically available to him in those countries.

In another case, the government argued that a Venezuelan applicant could safely live in Italy because of alleged dual citizenship. Blandon Law successfully challenged that argument, and the client ultimately won asylum.

Asylum law is constantly changing. Having an experienced attorney who understands these legal arguments can make a critical difference.
