NEWS UPDATE ‼️ Federal Court Rejects Royal Caribbean's Arbitration Bid ⚖🛳

In a significant ruling, a federal judge in the Southern District of Florida denied Royal Caribbean's motion to compel arbitration in litigation arising from the widely publicized hidden-camera voyeurism incidents aboard Symphony of the Seas.

The court adopted the magistrate judge's recommendation in full, allowing passengers' claims to proceed in court rather than through private arbitration. The lawsuit alleges negligence, emotional distress, and other claims related to a former crew member's criminal conduct involving the secret recording of passengers in their staterooms.

The decision highlights the ongoing legal scrutiny surrounding the enforceability of arbitration provisions in cases involving allegations of sexual misconduct and related harms.

Plaintiffs are represented by Jason Margulies and the team at Lipcon, Margulies & Winkleman, along with co-counsel, in the pending class action.

Our maritime expert, Michael Winkleman, was featured in Morning Star discussing whether cruise passengers could soon face fuel surcharges as rising operational costs continue impacting the cruise industry.

“Cruise lines often include provisions in their passenger ticket contracts that may allow them to impose fuel supplements under certain market conditions,” Winkleman explained. “Passengers should always carefully review the fine print so they understand what additional charges could potentially apply after booking.”

As the cruise industry continues adapting to changing global costs, transparency surrounding passenger contracts and pricing remains more important than ever. At Lipcon, Margulies & Winkleman, P.A., we continue advocating for passenger awareness, fairness, and accountability throughout the cruise industry.

Our maritime attorney, Jason Margulies, was featured in Fodor’s discussing some of the dirtiest places onboard cruise ships and the important health and safety precautions passengers should keep in mind while traveling at sea.

“High-touch areas onboard cruise ships can become breeding grounds for bacteria and viruses if proper sanitation protocols are not consistently followed,” Margulies explained. “Passengers should remain aware of hygiene practices and the cruise line’s responsibility to maintain safe and sanitary conditions throughout the vessel.”

As cruise travel continues to grow in popularity, passenger awareness and proper onboard sanitation remain critical components of a safe vacation experience. At Lipcon, Margulies & Winkleman, P.A., we continue advocating for passenger safety, accountability, and transparency throughout the cruise industry.

A tragic incident aboard Carnival Liberty has once again raised concerns surrounding passenger safety, emergency response protocols, and mental health awareness at sea after a guest reportedly went overboard while the ship was sailing near the Bahamas.

According to reports, the guest was recovered from the water following an immediate search effort by the crew, but sadly did not survive. Authorities continue investigating the circumstances surrounding the incident.

Cruise lines have a responsibility to maintain proper safety measures, emergency response procedures, and adequate monitoring systems onboard — especially during overboard emergencies where every second matters.

Our thoughts are with the guest’s loved ones during this difficult time.

Our maritime attorney, Jason Margulies, was featured in Travel + Leisure discussing why “ice class” ratings matter on Antarctica cruises and what travelers should understand before booking expedition voyages to remote, icy waters.

“One significant tradeoff is that the reinforcement of the hull for such vessels tends to create more noise and vibration compared to more conventional cruise ships,” Margulies explained. “These ships go slower, too, though you’ll enjoy prolonged views of your surroundings.”

The article explains how Polar Class ratings can impact where a ship can safely travel, how it handles changing ice conditions, and what kind of experience passengers may have during an Antarctic cruise.

As expedition cruising continues to grow in popularity, passengers should understand the risks, limitations, and safety considerations that come with traveling to some of the most remote destinations in the world.

Our maritime expert, Michael Winkleman was featured in CNBC discussing the growing concerns surrounding the deadly hantavirus outbreak linked to the expedition cruise ship MV Hondius, which has reportedly resulted in multiple deaths and international quarantine efforts.

“This situation highlights how quickly serious health risks can escalate in isolated maritime environments,” Winkleman explained. “Cruise operators have a responsibility to maintain proper health protocols, emergency response procedures, and clear communication with passengers when outbreaks occur onboard.”

Health officials continue monitoring passengers and crew after the suspected Andes strain of hantavirus — a rare strain capable of limited person-to-person transmission — was linked to the vessel during its South Atlantic voyage. Authorities across multiple countries have since launched tracing and quarantine measures tied to the outbreak.

The incident has renewed concerns about how cruise ships handle infectious disease outbreaks, particularly on remote expedition voyages where access to immediate medical care and evacuation resources may be limited.

Our maritime expert, Michael Winkleman was featured on 10News discussing the recent detention of multiple cruise ship workers by CBP at the Port of San Diego and the growing concerns surrounding immigration enforcement in the cruise industry.

“These crew members are the backbone of the cruise industry, and situations like this create fear and uncertainty for workers who are simply trying to provide for their families,” Winkleman explained. “Cruise lines and authorities must ensure that workers’ rights are respected throughout the process.”

The incident has sparked major conversations about crew member treatment, immigration policies, and the realities many international seafarers face while working aboard cruise ships.
