We’ve just been retained to defeat yet another proposed Battery Energy Storage System (BESS) facility near residential homes. After the largest BESS fire in US history, battery removal from the damaged facility began in late September, with strict protocols for de-energization and disposal.

Last week, we filed a federal class action against the City of Long Beach, for booting and/or seizing motor vehicles, simply because their owners had four or more unpaid parking tickets.

On a daily basis, local governments violate the rights of vehicle owners by booting, towing or seizing their vehicles without a warrant, and without affording them a vehicle seizure hearing.

We file federal actions to recover damages for vehicle owners whose cars have been booted and/or seized. We have handled over 7,000 vehicle seizure cases.

So among the many interesting conversations I have at parties, are those concerning civil forfeiture. When people ask me if taking cars away from drunk drivers is "fair," this is what I share with them. When Nassau County implemented its DWI forfeiture program, drunk driving offenses within the County were reduced by 36%, and the number of accidents caused by drunk drivers was reduced by 26%. This means that we prevent more than 1 out of every 4 drunk driving accidents from ever happening in the first place. It means that every night, someone's mother, father, sister, brother, son or daughter comes home alive. They come home because they weren't killed by a drunk driver, because I took away the drunk driver's car before he killed them. Or, even better, I scared someone away from driving their car after they have been drinking. I'm more than OK with that.
