Yesterday (Thursday) afternoon, Daryle Abeshouse and I attended with our daughter (Rachel Abeshouse) the Private Soft Opening of “Banh by Lauren,” at 42 Market Street (corner of Madison Street) in the Two Bridges area of lower Manhattan (adjacent to the Manhattan Bridge).

It was an event for Kickstarter supporters of this start-up venture by Rachel’s friends Lauren and Garland (husband and wife); their grand opening will be June 15, 2024. Before the pandemic, Lauren was pastry chef at restaurateur Danny Meyer’s renowned Gramercy Tavern. Her creations are, as a rule, delectable.

According to Wikipedia: In Vietnamese, the term bánh translates loosely as "cake" or "bread" but refers to a wide variety of prepared foods that can easily be eaten by hands or chopsticks.

Banh by Lauren currently offers a variety of mostly pastries and beverages, with a Vietnamese inflection. The build-out of the shop is lovely and comfortable. One of her creations is my favorite cake ever, but I won’t say which one, because several of the others are closely in contention – you can’t go wrong sampling a few…. There are even a couple of gluten-free options (and I wouldn’t have known if they hadn’t told me). Check them out after June 15!

Effective today (3/1/23), I now am officially fully retired.

As many of my friends and colleagues know, it’s been a gradual process:

I retired from practicing commercial litigation law in court in 2010, in favor of continuing my practice of Alternative Dispute Resolution Law (representing parties in business arbitration & mediation) and continuing to serve as a neutral Arbitrator & Mediator in business cases.

I next retired from practicing ADR Law, and from all practice of law, in 2016, in favor of serving exclusively as a neutral Arbitrator & Mediator in business cases.

I then semi-retired from serving as a neutral in late 2019, and ceased accepting new cases in early 2020. And now I am fully retired.

The first two partial retirements were voluntary, cutting out aspects of my practice in favor of others that I preferred.

The changes over the past four or so years were involuntary and reluctant, caused by severe chronic spine and hip pain (over the past 8 or so years) that inhibited and indeed precluded work at the high level I expected of myself. Numerous pre-surgical treatments (medical, homeopathic, and alternative/experimental), and two major surgeries (in 2020 and 2021), all proved unsuccessful.

I am learning to embrace this earlier-than-expected retirement. Over the past 2+ years, since I determined that full cessation of my career was inevitable, I have been compiling a list of things-to-do once retired. The first is to seek out more potential treatments, including, if necessary, more surgery (although I’d prefer to avoid that if possible) to quell the pain. After that I intend to take a deep dive into that lengthy list, and embrace it with the same energy and enthusiasm I did while practicing (only not for the same 90+ hours per week!).

I look forward to keeping in touch with many of you.

For nearly a decade, I have helped to facilitate the Three-Day Basic Commercial Mediation Training and the Two-Day Advanced Commercial Mediation Training programs offered by the NY State Bar Association. This year, I will be participating once again, with the programs presented via Zoom.

The Three-Day program is March 9 – 11, and the Two-Day program is April 21 – 22. Both are run by Simeon Baum and Stephen Hochman, who have done this training for two decades. It is advisable, but not necessary, to take the basic course before the advanced course. These courses are approved under Part 146 of the Rules of the Chief Administrative Judge, NYS Unified Court System.
