PREPARE FOR THE UNEXPECTED

Cultural tropes and entrenched narratives sometimes lead individuals preparing to enter into a marriage to regard prenuptial agreements with skepticism, but the truth is that the provisions in a prenup do not assume an untimely end to the relationship.

Rather, they outline a plan for the orderly division of shared resources and for ensuring that both parties are appropriately provided for if events take an unexpected direction.

One of our Laconia family law attorneys may be able to assist you by drafting or reviewing a prenuptial agreement.

SEPARATING AT MIDLIFE: ESSENTIAL GUIDELINES FOR DIVORCE AT 55

Divorcees over 50 years old often face additional financial challenges, such as dividing large and complex assets like real estate and more.

Additionally, it is much more important for older divorcees to ensure health insurance and retirement funds are accounted for and fairly divided in a divorce, which can introduce further legal issues.

Separating at midlife may also require divorcing spouses to rework their estate plans to address the change in marital status.

ADMINISTRATIVE REVIEW VS. ADMINISTRATIVE HEARING FOR ALS

New Hampshire drivers can appeal an administrative license suspension in either of two ways: an administrative review or an administrative hearing.

The former involves a motorist submitting a written request with supporting evidence to the DMV, and after reviewing these documents, the DMV then determines whether they will cancel the suspension or let it stand.

By contrast, the latter is an in-person hearing providing drivers with an opportunity to argue their case directly.

One of our DWI defense attorneys may be able to help you understand the legal options available to you.

What Age Group Has The Most Drunk Driving Accidents?

Because any factor that contributes significantly to traffic fatalities demands close scrutiny, lawmakers and public safety officials pay careful attention to demographic data such as gender and age group that may help to identify the drivers most likely to be involved in drunk driving accidents.

The goal, usually, is not to “profile” these drivers in a punitive way, but to find ways to more effectively reach these drivers with information about the risks of drunk driving, in order to encourage responsible decision-making.

SHOULD YOU CHALLENGE THE RESULTS OF A BREATHALYZER TEST?

Depending on the DUI case, challenging the results of a Breathalyzer test may have multiple outcomes.

For example, if the court determines the results to be unreliable, or if they believe law enforcement did not follow the correct procedures when administering the test, they may dismiss the DUI charges.

This outcome may be particularly likely in cases where the Breathalyzer results are the main piece of evidence against the driver.

NEW HAMPSHIRE MODIFIED COMPARATIVE NEGLIGENCE

Under New Hampshire’s modified comparative negligence law, as long as a party is not more than 50% responsible for the accident, they can receive compensation.

However, the compensation they will receive will be reduced by their percentage of fault.

As a result, sometimes the extent as well as the existence of fault may be disputed in a New Hampshire personal injury case.

IS THE DRIVER LIABLE IN A TRUCK ACCIDENT?

If you are injured in a New Hampshire trucking accident, you may have questions about who is legally responsible for your injuries.

The answer is sometimes the truck’s driver, but not always.

Additionally, in truck accidents it is not unusual for more than one party to share part of the liability.

This type of complexity helps to explain why many New Hampshire residents who have been harmed in accidents with commercial vehicles prefer to work with an experienced personal injury lawyer, rather than attepting to navigate their claims alone.

NEW HAMPSHIRE SLIP & FALL

“Slip and fall” is a common term for a subtype of premises liability claim in which one person is injured in an accident on someone else’s property.

Usually the claim the injured person makes is that the property owner’s negligence created unsafe conditions on the property, thereby causing the accident and its resulting injuries.

If the accident victim can prove their case, they may be entitled to compensation.

Can Security Guards Detain You In New Hampshire?

Under New Hampshire law, security guards at county fairs and some business locations can detain individuals under certain circumstances.

Separate statutes authorize these limited detentions for the fairgrounds vs. business premises, and the circumstances under which a security guard may detain someone are specific to the type of premises on which the detention would be carried out.

In all cases, a security guard may detain someone only for as long as it takes to surrender the individual to a duly authorized peace officer.
