Did you know....not all deeds are created equal.
Which Type of Deed Do You Need in Arizona?
Not all deeds accomplish the same goal. Choosing the wrong deed can create unintended legal consequences. Here's a quick guide to some of the most common deeds used in Arizona.
🏡 Beneficiary Deed
A Beneficiary Deed allows real property to transfer directly to your chosen beneficiary upon your death—without going through probate.
✅ Avoids probate
✅ You keep complete ownership during your lifetime
✅ Can be revoked or changed at any time while you're alive
✅ Excellent estate planning tool for many Arizona homeowners
✍️ Quitclaim Deed
A Quitclaim Deed transfers whatever ownership interest the grantor has—but makes no promises or guarantees about the title.
Common uses include:
• Transferring property between family members
• Adding or removing a spouse after marriage or divorce
• Correcting title issues
• Moving property into or out of a living trust
⚠️ A quitclaim deed does not guarantee clear ownership.
🛡️ Warranty Deed
A Warranty Deed provides the highest level of protection for the buyer. The seller guarantees they own the property and have the legal right to transfer it, free from undisclosed title defects.
Commonly used when:
🏠 Buying or selling real estate
🏦 Lenders require title assurances
📑 Traditional real estate closings
📄 Special Warranty Deed
A Special Warranty Deed provides a more limited guarantee. The seller only warrants that no title defects occurred during their period of ownership, not before they acquired the property.
Often used in:
• Commercial transactions
• Transfers by businesses or trusts
• Certain investment properties
Which Deed Is Right for You?
