Did you know IRA (and 401k) inheritences can be one of the most tricky assets?

Why?

1) Your will does not control your retirement account. The beneficiary form does.

2) Three law changes in the last 11 years have flipped the inherited IRA world on its head. What were those changes?

i) 2014 - the Supreme Court took away bankruptcy protection for inherited IRAs. Meaning your IRA is open to your kids creditors.
ii) 2019 - Congress took away the stretch. No longer can you stretch withdrawals over your lifetime with an inherited IRA. It must be taken out within ten years for most beneficiaries.
iii) 2024 - The IRA rewrote the complete rule book. 260 pages of regulation that completely changed inherited IRAs. Honetly, this finally gave us a workable system for multiple beneficiaries.

Estate planning is not as simple as it appears.

Every asset varies.
