๐•๐ˆ๐’๐€ ๐”๐๐ƒ๐€๐“๐„: The U.S. Department of State has launched a new pilot program allowing B-1/B-2 visa applicants to pay $750 for a faster interview appointment.

Running July 1 through December 31, 2026, the program is available at participating U.S. embassies and consulates and is open to any B-1/B-2 applicant, not just emergencies.

The court found that the executive branch lacks the authority to impose this fee without Congressional approval. What this means right now:

On June 5, 2026, a federal judge in Rhode Island ruled that USCIS acted unlawfully when it implemented policies that indefinitely paused the adjudication of immigration benefit applications filed by individuals from 39 designated countries.

The challenged policies had affected a wide range of immigration benefits, including:

โ€ข Adjustment of Status (Green Card Applications)
โ€ข Employment Authorization Documents (Work Permits)
โ€ข Naturalization Applications (Citizenship)
โ€ข Asylum Applications
โ€ข Other USCIS immigration benefits

Rather than approving or denying these applications, USCIS had placed many cases on indefinite hold based solely on the applicant's country of nationality. The court found that USCIS lacked legal authority to impose these blanket adjudication freezes and ordered the policies to be vacated and set aside.

USCIS has issued a policy memorandum calling adjustment of status an "extraordinary" form of relief that should not replace the standard consular immigrant visa process.

๐‡๐ž๐ซ๐ž ๐ข๐ฌ ๐ฐ๐ก๐š๐ญ ๐ญ๐ก๐š๐ญ ๐š๐œ๐ญ๐ฎ๐š๐ฅ๐ฅ๐ฒ ๐ฆ๐ž๐š๐ง๐ฌ.

The law has not changed. USCIS has always had this same discretionary authority to approve or deny adjustment of status applications. This memo restates that. It is not a new regulation. It does not automatically affect your pending case or mean green card approvals are over.

That said, we are not going to tell you this memo is meaningless. We believe it signals that the administration intends to find ways to reduce the number of people approved for permanent residence. How officers weigh cases going forward may shift, even if the underlying law stays the same.

Family-based cases, particularly those involving someone who has fallen out of status, carry the highest risk under this guidance. Employment-based cases, including H-1Bs and TNs going through PERM, are less immediately affected. However, a footnote in the memo noted that simply maintaining valid employment visa status may not guarantee a favorable outcome at the adjustment of status stage.

The law is the same. How cases are decided may change. We are watching closely, litigation is expected, and a future change in administration could reverse course entirely.
