Partner and Co-Chair of Lewis Brisbois’ Illinois Biometric Information Privacy ( ) Practice Mary Smigielski recently spoke with Cybersecurity Law Report (CSLR) for an article titled, “BIPA Litigation Dynamics Following Seventh Circuit Clay Decision,” which discusses the implications of the Seventh Circuit’s April 2026 decision in Clay v. Union Pacific Railroad Company. That decision significantly reduced damages exposure under BIPA by holding that “stacking” of statutory penalties is not permissible, eliminating a theory of potentially catastrophic that some plaintiffs have advanced.
