Shant Karnikian, Michael Childress, and David Furtado of Furtado Law PC co-authored a new article on how insurers are cutting off Additional Living Expense benefits to wildfire policyholders in violation of California law.

California Insurance Code section 2060 guarantees policyholders at least 24 months of ALE coverage following a declared state of emergency. Yet carriers are routinely terminating those benefits early by conditioning payments on rebuild progress, a requirement that appears nowhere in the statute.

The authors are calling on the California Department of Insurance to open a market conduct examination into how carriers are handling ALE claims arising from the Eaton and Palisades fires.

Shant was recognized for leading one of the most active disaster and mass tort litigation practices in the state, including cases tied to the Eaton Canyon Fire and Maui wildfires, alongside his work in insurance bad faith litigation.

We secured a $950,000 settlement for an elderly client injured when a truck made an illegal U-turn. By quickly obtaining key video evidence in the days immediately following the incident, we were able to shape the narrative from the outset. The defense pointed to limited treatment and damages in valuing the case in the five figures. We rejected that framing—because limited treatment doesn’t mean limited harm, especially for an older client—and drove a result that reflects the true value of the claim.
