Immigration sponsorship is based on a specific employer, position and set of working conditions.

When one of those details changes, HR should not assume that an existing approval automatically covers the new arrangement. Some changes may require a new or amended filing, while others may simply require documentation.

A quick immigration review before implementing the change can prevent a much larger issue afterward.

If you are entering the U.S. using a visa, do not assume that your admission record is correct simply because you entered the United States without an issue.

After international travel, you should always retrieve your new Form I-94 and review:

• Your name and passport information
• Your immigration classification
• Your most recent entry date
• Your “Admit Until” date

If anything appears incorrect, contact immigration counsel promptly to determine the appropriate correction process.

A two-minute review after each trip may help identify an error before it affects a future filing, employment verification or immigration deadline.

Moving involves a long list of updates from your bank to your internet provider to your Costco membership, and USCIS should not be overlooked.

Updating your address with the U.S. Postal Service (USPS) does not update it with USCIS, and USPS generally will not forward USCIS mail. Most noncitizens in the United States must report an address change to USCIS within 10 days by filing Form AR-11 (available online), although exceptions apply.

If you have pending cases, confirm that the address is updated appropriately for each matter and keep a record of the change.

Missing an important notice because it was sent to a previous address can create avoidable complications.

Your passport, visa, Form I-94, approval notice and employment authorization document may all display different expiration dates and they do not all mean the same thing.

Confusing one date for another can affect travel, employment and maintenance of immigration status.

Keep copies of your current documents, track each expiration separately and ask immigration counsel which date controls your particular situation.

A new Executive Order could bring additional scrutiny to H-1B filings, particularly for employers that have recently conducted layoffs or anticipate layoffs in the future.

The order directs the Departments of Homeland Security, Labor and State to consider an employer’s layoff activity, along with broader U.S. labor market and economic data, when reviewing certain H-1B petitions, visa applications and Labor Condition Applications.

Exactly how these agencies will implement the new requirements remains to be seen, and additional guidance is expected. Employers sponsoring H-1B workers should be prepared for increased scrutiny of factors including workforce reductions, offered wages, job duties and position requirements.

A recent UCLA graduate with a Bachelor of Arts in English, Mallory brings previous legal-assistant experience, a keen eye for detail and a strong commitment to providing clients with thoughtful, attentive support.

She is also a fan of Sally Rooney, Toni Morrison and Jane Austen, believes pop music is popular for a reason and considers a beach day with a great sandwich, an impossible-to-put-down book and good friends her idea of perfect happiness. We have a feeling she is going to fit in very well here.

The Department of Homeland Security has submitted a proposed rule titled “Eliminating the Discretionary 60-Day Grace Period” for federal review.

Under the current regulations, certain employment-based nonimmigrant workers may receive a discretionary grace period of up to 60 days or until the expiration of their authorized stay, whichever is shorter, after their employment ends. This period can provide valuable time to pursue new employment, seek a change of status or prepare to depart the United States.

If finalized, the proposal could significantly affect both international employees and the employers seeking to hire them following a termination or layoff.

Importantly, nothing has changed yet. The proposal remains under review, its full text has not been publicly released and the existing grace period remains in effect.

We will continue monitoring the rulemaking process and provide updates as additional details become available.
