The 75-country visa ban is struck down! Judge Vargas gave both sides until September 11 to propose how to resolve what remains of the case. The Trump administration can appeal the ruling and is very likely to do so. We will update with more as this news develops.

¿Vas a pedir tu residencia este otoño? Las reglas de carga pública acaban de cambiar.

Desde el 18 de septiembre, USCIS considera cualquier beneficio basado en el ingreso, como SNAP, WIC, Medicaid o ayuda de vivienda. Y no es solo lo que tú recibes. Los beneficios usados por personas en tu hogar que mantienes económicamente también pueden afectar tu caso.

Los oficiales revisan la evidencia detrás de los factores requeridos: edad, salud, familia, finanzas, educación, habilidades, y la evalúan en conjunto como un panorama completo. Ningún factor decide un caso por sí solo.

Si carga pública es el único problema, USCIS tiene la discreción de dejar que el solicitante pague una fianza en vez de negar el caso, básicamente un depósito, con un monto que determina USCIS, y que eventualmente se devuelve si no se solicitan beneficios públicos.

Filing for your green card this fall? The public charge rules just changed.

Starting September 18, USCIS looks at any means-tested benefit, like SNAP, WIC, Medicaid, or housing assistance. And it's not only what you receive. Benefits used by household members you financially support can factor in too.

Officers look at the evidence behind required factors: age, health, family, finances, education, skills, and weigh it together as a whole picture. No single factor decides a case on its own.

If public charge is the only problem, USCIS has the discretion to let the applicant post a bond instead of denying the case, essentially a deposit, an amount set by USCIS, and is eventually returned if no public benefits are requested.

If you have advance parole and are planning to travel outside the US, please read this carefully.

On August 13, 2026, the Board of Immigration Appeals issued a ruling in Matter of Delcarmen-Lara, overturning a rule that had been in place for 14 years.

Before this decision, traveling with advance parole generally did not affect your ability to apply for a green card even if you had unlawful presence on your record. That is no longer the case.

If you travel after August 13 with advance parole and have unlawful presence on your record, that trip now counts as a formal departure and can trigger a 3 or 10 year period during which you cannot apply for a green card.

This affects DACA recipients, TPS holders and anyone with a pending green card application who has ever been out of status.

If you traveled before August 13, you are not affected.

If you do travel after August 13 and this affects you, it does not mean your case is over. You may still have options such as applying for a waiver if you have a qualifying US citizen or permanent resident spouse or parent, or waiting out the period inside the United States.

Every case is different. Do not make any travel decisions without speaking to an immigration attorney first.

Si tienes advance parole y estás planeando viajar fuera de los Estados Unidos, por favor lee esto con cuidado.

El 13 de agosto de 2026 la Corte de Apelaciones de Inmigración (BIA) emitió una decisión en el caso Matter of Delcarmen-Lara, revocando una regla que había estado vigente por 14 años.

Antes de esta decisión, viajar con advance parole generalmente no afectaba tu capacidad de solicitar la residencia permanente aunque tuvieras presencia ilegal en tu historial. Eso ya no es el caso.

Si viajas después del 13 de agosto con advance parole y tienes presencia ilegal en tu historial, ese viaje ahora cuenta como una salida formal del país y puede activar un período de 3 o 10 años durante el cual no podrías solicitar la residencia permanente.

Esto afecta a beneficiarios de DACA, TPS y personas con solicitud de residencia pendiente que alguna vez estuvieron sin estatus legal.

Si viajaste antes del 13 de agosto no te afecta.

Si viajas después del 13 de agosto y esto te afecta, no significa que tu caso terminó. Puede que aún tengas opciones como solicitar un perdon si tienes un cónyuge o padre con ciudadanía o residencia permanente, o esperar el plazo dentro de los Estados Unidos.

Cada caso es diferente. No tomes ninguna decisión de viaje con advance parole sin hablar primero con un abogado de inmigración.

Si está por presentar algún trámite con USCIS, ponga atención a esto.

Una nueva regla federal le permite a USCIS exigir que ciertos formularios de inmigración se presenten únicamente en línea. Ya no se podrán enviar por correo. Todavía no es obligatorio, pero cuando USCIS decida hacer el cambio en un formulario, solo tienen que avisar con 60 días de anticipación antes de dejar de aceptar solicitudes en papel. Si se le pasa ese plazo, su solicitud podría ser rechazada.

Existe una opción de exención por dificultad para quienes realmente no puedan presentar su trámite en línea, pero no es automática. Se revisa y se otorga caso por caso.

Las reglas de inmigración pueden cambiar rápidamente, y un error en su trámite le puede costar tiempo, dinero o incluso su caso. Nuestra oficina se mantiene al tanto de cada cambio para que los casos que manejamos se presenten correctamente desde el principio.

If you're planning to file anything with USCIS, pay attention to this.

A new federal rule now lets USCIS require certain immigration forms to be filed online only. No more mailing them in. Nothing is required yet, but once USCIS decides to switch a form, they only have to give 60 days notice before paper filings for it stop being accepted. Miss that window and your application could get rejected.

There is a hardship waiver option for people who genuinely can't file online, but it's not automatic. It's reviewed and granted case by case.
