I’m Sheena Rickerson, a Florida Supreme Court Certified Family Law Mediator. I offer mediation for divorce, parenting plans and time-sharing, child support, property division, paternity, modifications, and other family law matters.

Florida criminal law changes are coming October 1, 2026. A new charge, a bond condition, or a registration deadline can have serious consequences. Here are six changes to know:

Pretrial no-contact orders: Willfully violating a no-contact condition after an arrest for certain violent offenses will become a separate first-degree misdemeanor. A second or subsequent violation can be a third-degree felony. HB 397. (flsenate.gov, flsenate.gov)

Xylazine and nitrous oxide: Florida will create a xylazine trafficking offense with penalties tied to the amount involved. A separate provision will restrict nitrous oxide on licensed to***co or ni****ne retailers’ premises. SB 432. (flsenate.gov, flsenate.gov)

Gang-membership criteria: The law will expand the evidence that may count toward identifying someone as a criminal gang member, including certain online statements and specified associations. The statutory definition requires at least two qualifying criteria. HB 429. (flsenate.gov, flsenate.gov)

Career offender registration: People subject to Florida’s Career Offender Registration Act will face revised in-person registration and continuing reporting requirements. Certain failures to register or report required changes will be separate third-degree felonies. SB 1332. (flsenate.gov, flsenate.gov, flsenate.gov)

Lewd conduct involving a child: A new third-degree felony will address specified lewd exposure or sexual conduct while observing a child under 16 for sexual gratification. HB 1525. (flsenate.gov, flsenate.gov)

Animal cruelty involving minors: New felony provisions will apply to specified animal cruelty conduct committed in a minor’s presence or when an adult causes or entices a minor to commit it. HB 559. (flsenate.gov, flsenate.gov)
