Can You Get a DUI in a Self-Driving Tesla in California?
The short answer is yes.
Many Tesla owners believe Full Self-Driving (FSD) technology protects them from DUI charges. California law says otherwise.
In a recent case, a driver was found passed out while his Tesla continued navigating city streets. Despite the vehicle operating in self-driving mode, he was still arrested for DUI.
The reason is simple: California law still requires a licensed driver to remain responsible for the vehicle. Self-driving technology is not a legal defense to a DUI charge.
Former Los Angeles prosecutor Richard Wagner explains what Tesla owners need to know, how California courts view self-driving vehicles, and why relying on autopilot can still result in a DUI arrest.
