I'm Daragh Carter and I'm an attorney licensed in the State of Texas since 2005. 100% of my law practice is representing clients in personal injury cases. Just wrapped up a premises liability trial in Stephens County. The verdict did not go my client’s way, but how cool to try a case in my wife’s hometown. The courthouse turned 100 years old on the second to last day of trial.

Well, well, well.

These are the defendant's discovery responses in a drunk driving auto accident. I have video showing her lights were off when she crashed into my client, totaling his car, and only means of getting to work. Her insurance company wouldn't accept liability, notwithstanding that she was arrested for DWI, and the police report said her BAC was 0.151.

Turns out, she's an insurance claim adjuster. I asked for her employer's name, which they didn't provide (that's ok, I will get it).

Trial report. State Farm's initial offer before suit was filed was about $9,600. Highest offer was $22,000 a few weeks before trial. State Farm had multiple chances to settle for their insured's $50K policy limit.

After a two-day trial in Harris County, the jury returned a verdict of $84,000. With pre-judgment interest and some taxable costs, the final judgment should be for about $105,000.

I'm glad for my client who, as I told the jury, is a regular person like the rest of us who just happened to get hurt in a car crash that wasn't her fault.

Happened upon this wreck at a 4-way stop in The Heights this morning. Bet neither driver has a dash cam. Swearing matches over who ran a light or a stop sign are a real stinker with no video or independent witnesses.

Do yourself a big favor and get a dash cam. Don’t keep putting it off! Cheapest insurance you’ll ever buy.
