Thank you The Hawk’s Eye - C & N for bringing my client's story to the public.
🚨⚖️ Filed — and already in the headlines.
I (Vincent Law, PLLC ) initiated a Federal Civil-Rights lawsuit against the City of Magnolia and Magnolia PD arising out of a dismissed DWI arrest and related constitutional violations 📜.
Notably, the defendants have not yet been served with process, yet the case has already drawn media attention.
Civil-Rights litigation is trial work. When Constitutional protections are violated, the remedy is in federal court before a jury.
Federal court. Jury trial requested. 🏛️
Accountability is pursued there. This is the work. 💪
🚨 Federal Civil-Rights Lawsuit Filed Over Dismissed Magnolia DWI Arrest 🚨
A newly filed lawsuit in federal court alleges that a February 2024 traffic stop in Magnolia escalated into an unlawful arrest, an invasive blood draw, denial of medical care, and lasting reputational harm.
The case names the City of Magnolia, Police Chief Kyle Montgomery, Officer J. Cortez, Officer T. Galvan, and Sergeant P. Hudson in connection with the stop, arrest, and related decisions. Court filings claim no traffic violation occurred, question the basis for the DWI investigation and warrant, and state toxicology results later showed no alcohol or unlawful substances. Prosecutors ultimately dismissed the charge after about ten months.
The lawsuit also alleges denial of prescribed medication during detention and public social-media posts about the arrest that caused personal and family-court consequences. The filing seeks damages, attorney’s fees, and a jury trial.
All allegations remain subject to challenge and must be proven in court.
