What happens when a celebrity car crash case goes to a jury? ⚖️ Read this quick insider note from our own Attorney Jesse:
Howdy,
I'll admit, I don't have much in common with Ellen DeGeneres. She's danced with presidents. She was also apparently a bit on the harsh side with how she treated her staff. I, on the other hand, dance alone and my staff actually accuses me of treating them too well!
But her car crash case in nearby Santa Barbara County has plenty to teach the rest of us. In fact, you might have seen this new development a few months back. The woman she allegedly hit is now asking for a jury trial.
This all goes back to 2023. The plaintiff says she was stopped at a four-way intersection, checked for traffic, and pulled out once it looked clear … which is right when DeGeneres's car allegedly ran the stop sign and T-boned her Tesla.
The core claim of the lawsuit against DeGeneres is negligence: that her conduct fell below the “standard of care” a reasonable driver owes everyone else on the road. That's a legal standard, but it's also common sense. And it's exactly what's playing out here in two ways.
Two things worth noting here:
1.) A jury trial request means the case isn't settling quietly. Insurance companies usually want disputes resolved privately, away from ordinary people who might sympathize with an injured plaintiff and award real money for pain and suffering. Asking for a jury means either no fair offer ever came, or she's not taking the one on the table.
2.) A clean liability claim doesn't guarantee a fair one. California Vehicle Code 21802 gives the right of way to whoever's already in the intersection when someone blows a stop sign. She did everything right and still had to fight for it. Famous defendant or not, it's the same playbook, just with a different size of checkbook on the other side.
If you're in an accident at a stop sign or intersection, call me. We'll help you find the right way forward.
