Your lawyer shouldn’t be an emotional support animal that sends you an expensive hourly invoice.

The stories I hear in my office often pull at my heartstrings. (Yes I still have heartstrings after practicing law for 21 years 😉)

Divorce hurts. Being wrongfully accused can turn your life upside down. And custody battles? Few things stir stronger emotions than our love for our children and our determination to do what’s right for them.

Lawyers are paid handsomely by the hour. If all you’re getting is sympathy and agreement, that’s some awfully expensive reassurance.

What you should be using your hard earned money on is paying for legal analysis, honest advice, and advocacy. Lawyers are trained to guide you through a difficult, emotional legal problem. Providing professional counseling requires different training.

That’s why I often encourage clients to see a professional counselor. Your emotional needs deserve real attention from someone equipped to help, often at a much lower hourly rate. Getting that support can help you handle the stress while we work through the legal decisions.

And sometimes my legal advice sounds like:

“Don’t send that text.”
“No, Facebook isn’t the court of appeals.”
“Yes, I read what they said. Still don’t do that.”

That text might feel great for five minutes. You could spend a lot longer explaining it on the stand.

“The law changed! My cousin Bubba says he got 50/50, so I should, too.”

Your cousin Bubba’s case isn’t yours. Different parents. Different children. Different situations.

But you are right! Louisiana’s custody laws have changed.

Two major changes took effect August 1, 2026:

1) Equal parenting time has stronger support. When a court awards joint custody, the law now requires equal time unless the judge finds it isn’t practical or isn’t in the child’s best interests.

2) Changing an existing custody order has its own rules. Louisiana put the long standing LA Supreme Court “Bergeron Standard” into written law, with modifications that include a five-year distinction for certain court-decided custody judgments. What you must prove depends on how your order was entered, how old it is, and what’s changed.

There’s a financial piece, too. Moving to shared or equal parenting time can also significantly affect the child support you pay or receive. But 50/50 doesn’t automatically mean nobody pays support. Both parents’ incomes, parenting time, and expenses for the children affect the calculation.

These law changes don’t automatically rewrite your existing custody or support orders. Something has to be filed with the Court and a local Judge has to make a ruling.
