Do not wait until your law license is in jeopardy to hire ethics counsel. When the Office of Attorney Ethics contacts an attorney, the response from day one matters. I recently represented an attorney who initially chose to handle an ethics grievance without counsel. By the time she retained my firm...

Congratulations to partner Glenn R. Reiser on his landmark victory before the New Jersey Supreme Court in a case declaring New Jersey's Tax Sale Law unconstitutional. As a result of this ruling, the firm's client retains ownership of his property valued at more than $500,000.

This past week we successfully resolved a bitter estate litigation involving 5 family members. As a result of the settlement, one of the brothers whom the Court removed from his position as executor was disinherited.

Very pleased to have resolved a substantial commercial real estate loan foreclosure today on behalf of corporate borrowers and individual guarantors who had purchased an iconic inn/restaurant in New Jersey, but were unable to open and operate it due to Covid.

As part of a loan workout, our clients purchased the loan back from the lender at a discount and then sold/assigned the loan to a third party purchaser, who agreed to extinguish the original debt by accepting a deed in lieu of foreclosure.

At the end of the day, our clients avoided a $1.3 million deficiency judgment that loomed in a separate lawsuit brought by the bank against the guarantors on the underlying promissory note.

We're very pleased to announce a major victory for our client, an owner of a commercial property who recovered title to the property that had been lost due to tax foreclosure judgment. The property was valued at least 10 times greater than the amount of the tax sale certificate, and our client suffered a loss of rental income during Covid 19 which prevented him from raising the money needed to pay the tax lien. The Court vacated the tax foreclosure judgment and provided our client with a period of 45-days to pay off the judgment and reimburse the plaintiff for its legal fees.

The win is significant because the property is unencumbered by a mortgage. Absent today's decision, our client stood to lose his entire equity position in the property.

The case is 257-261 20th AVENUE REALTY LLC, vs. ROBERTO, Superior Court of New Jersey, Chancery Division, Passaic County, Docket No. F-3349-21.
