For most people, resistance to estate planning isn't really about not caring. It's about what planning requires them to confront.

Wills. Trusts. Powers of attorney. These conversations point directly at something most of us would rather not think about: death, incapacity, and the possibility that something goes wrong. For some people, planning for those scenarios feels like inviting them. There's also a quiet kind of optimism that quietly derails every attempt. If your spouse genuinely believes everything will be fine, planning for "just in case" feels unnecessary, not unreasonable from where they're standing. Just not urgent.

This matters because it tells you something important: logic and risk statistics are probably not the approach that will move them. This isn't a logic problem. It's an emotional one.

You've brought it up before. Maybe it was after watching a friend go through a probate that dragged on for years. Maybe a health scare prompted the conversation, or a birthday that snuck up faster than expected. Whatever brought it to mind, you tried to talk to your spouse about getting your estate plan done.

Did you know? A stepparent has no automatic authority to make medical decisions for a stepchild, not even if they have been the child's primary caregiver for years.

In an emergency, without a specific legal document in place, you are a legal stranger. The hospital has no obligation to consult you. A biological relative who shows up may have more standing than you do, regardless of how many years you have been their parent.

The document that changes this is straightforward. But it has to exist before the emergency, not after. Once you are already in the waiting room, it is too late.
