Q1. How long will it take to get my Employee Retention Credit? (updated October 19, 2023)

A1. We understand the importance of these credits, and we appreciate the patience of employers and tax professionals as we continue to get valid claims processed – while also protecting against fraud.

On September 14, 2023, amid rising concerns about a flood of ineligible ERC claims, the IRS announced an immediate moratorium through at least the end of the year on processing new ERC claims to protect honest employers from scams.

The IRS is processing ERC claims received before September 14, however, processing has slowed due to the complexity of the amended returns and the increase in aggressive and misleading marketing campaigns luring taxpayers into claiming the ERC when they are not eligible for it. There are very specific eligibility requirements for claiming the ERC, so all claims must be reviewed. We apologize for the delay.

The Arkansas Secretary of State is once again collecting franchise taxes for all companies registered with the State of Arkansas. Due to the recent transition of franchise taxes from the Department of Finance and Administration back to our office, Secretary of State John Thurston has waived the penalty and interest on 2021 franchise taxes until July 15th.
Arkansas state law requires all Corporations, LLCs, Banks, and Insurance Companies registered in Arkansas to pay an annual franchise tax. Failure to pay can result in the imposition of additional fees, penalties and interest, or even revocation of the authorization to do business.
Franchise taxes continue to accrue, even for revoked businesses, until the business is dissolved, withdrawn, or merged. Any additional filings with our Business & Commercial Services division will be prohibited for persons or entities that fail to pay the franchise tax. .

The 411 on the CTC

The majority of eligible households will NOT need to take any action in order to receive the upcoming Child Tax Credit (CTC).

The advanced payments will start directly depositing into bank accounts on July 15, and monthly on the 15th through this year unless that day falls on a weekend or holiday. For any client who has NOT filed a 2020 or 2019 tax return, there could be issues if they expect to receive CTC payments as their eligibility will be skewed without recent tax return information, and then there’s also the issue of the IRS not having updated bank account info. Advise those clients to send in the information you need to complete their return ASAP if they want the monthly cash boost.

By accepting the monthly payments now (and not actively opting out), you can clear any confusion for your clients who think they will still receive a lump sum at the end of the 2021 filing year — that is NOT the deal. If any of your clients have lengthy, complicated tax planning processes in play, you may want to advise them to opt out of the monthly payments. In that case, keep your eye out for the IRS to launch the new Child Tax Credit Update Portal, which is where folks can elect to opt out. Households which do opt out will be eligible again to receive a lump sum CTC payment after filing their 2021 return next spring.

And last but not least, the CTC payments are nontaxable when it comes to filing 2021 returns.
