Imagine this... your dad needs nursing home care and you assume Medicaid will help cover it. Then you learn the state is reviewing every gift, transfer, and "loan" he made to family over the last five years.

That review is Michigan's five-year Medicaid look-back. When someone applies for long-term care Medicaid, the state examines asset transfers made in the 60 months before the application.

Transfers made for less than fair market value can trigger a penalty period. The good news is that lawful planning done early gives families real options.

Probate. It's a word Genesee County families hear after losing a loved one, but rarely understand.

The court appoints a personal representative. This person receives legal authority to act on behalf of the estate through "Letters of Authority."

That representative must locate and secure all assets. Creditors get notified. Valid debts get paid. Tax returns get filed. Only then can remaining assets transfer to heirs.

The timeline? Most cases take seven months to a year. Delays happen when assets are hard to locate or disputes arise.
