Here is a brief overview of what to know:

🔹Miranda rights apply only when you are both in custody and being questioned.
🔹Not all police encounters, like traffic stops or brief questioning, require Miranda warnings.
🔹Violations of Miranda rights may exclude statements from evidence but do not automatically dismiss the case.

You're sitting in a meeting when your phone buzzes. It's your brother: 'Let's not rock the boat until the estate closes.' He's not the one filing the paperwork.

In Michigan, you don't have to wait for a final accounting to ask what's happening to the money. Personal representatives owe beneficiaries duties of loyalty and transparency the whole time the estate stays open, not just at the very end, and annual accountings are supposed to go out along the way. Courts can compel an accounting, restrict a fiduciary's powers, or remove one for cause, long before any closing statement gets filed.

What raises flags for us is delay. A late inventory. Withdrawals nobody can explain. A 'reimbursement' that doesn't add up. Those patterns matter most while the estate is still open, because that's when assets can still move.
