What does “passing the trash” actually mean?

When an educator is accused of serious misconduct, they may be allowed to resign, transfer, or move onto another position rather than being terminated. This can leave important questions about accountability, and whether future students are being protected.

Understanding how institutions respond to allegations is an important part of understanding the bigger picture.

When a teacher is accused of sexual abuse, what happens next can have lasting consequences.

In our experience, these situations don’t always end with termination. Instead, an accused teacher may be placed on administrative leave, reassigned, transferred, or allowed to resign. This pattern is sometimes referred to as “passing the trash.”

After experiencing sexual abuse, many survivors aren't aware that there may be different legal paths available.

Criminal and civil cases serve different purposes, and understanding those differences can help survivors make informed decisions about what comes next. One path focuses on criminal accountability, while the other may provide an opportunity to pursue accountability through the civil justice system, including claims against institutions when supported by the facts.
Every survivor's situation is unique, and there is no one-size-fits-all approach. If you're unsure what options may be available to you, we're here to answer your questions with compassion, respect, and confidentiality.

Meet Morgan McClintock ⚖️

For Morgan, what makes MJC special is the people. She loves being part of a team where everyone is dedicated to their work, values collaboration, and is always learning and growing together. Knowing her ideas and perspective are heard has made her especially proud to be part of the Criminal Defense department.

Outside of the office, Morgan is an Ivy Tech graduate who is preparing to continue her education in Political Science with a Pre-Law concentration. When she's not working, you'll likely find her on the softball field coaching her daughter's rec and travel ball teams. Her go-to snack? Thin white chocolate Reese's cups... preferably frozen.🥎🤍
