We peace of mind to businesses and individuals in the areas of real estate, contracts and financial disputes. I love to demystify complicated real estate and financial legal concepts and problems for people who are frustrated, "spinning their wheels" with incompetent or dismissive real estate or banking "professionals." I hate when someone finds themselves at a legal disadvantage - they're "stuck"

when they unknowingly relying on outdated or impractical information and forms off of the "internet." It's unfortunate when someone bases their legal decisions off of "outside chatter." They rely on the opinion of someone they hardly know, (or worse, friends or family members) who is NOT a licensed and experienced real estate or finance attorney, and frankly, has no "skin in the game." For the above reasons, I actively write, publish and create books, articles, podcasts, slide presentations and newsletters -all designed to simplify complicated legal concepts related to real estate and finance. I strive to make these resources user -friendly and practical so that someone with a legal concern can understand how to reduce their legal liability and financial exposure in the real estate and debt arenas.

Question: "I had a fire at my building. The company I bought it from through a land contract, still shows as the insured. Do I have a right to the insurance proceeds even if I am not named on the fire policy? The seller says I am not entitled to the insurance proceeds."

David's Answer: The insurance company will pay the claim to whoever is listed as a "loss payee" on the policy. How insurance proceeds will be handled thereafter will be controlled by the land contract provisions. This is an important clause that should be in every real estate contract. So, if your seller is named on the policy, and you are not, your attorney would have to review the contract to make the claim for proceeds against the seller. Just a word of note, nothing stops you from being listed as a proposed insured on a property casualty agreement since it sounds as if you have an 'insurable interest'.

Question: "I purchased a home from a self-professed real estate 'Guru'. He said the home was 'turn-key' which means that the house is in good shape and there is a renter already in the property. I come to find out that after the closing, the home has been deemed 'uninhabitable' by the City and they want it demolished. I am out over $53000 - What can I do? Is the 'Guru' liable to me?"

David's Answer: Whether or not the 'Guru' is liable to you will depend on the contract and also on the extent of the due diligence that you undertook on your own. Before purchasing a property, the buyer should always take a 'due diligence' period to inspect the home and verify the municipal codes that regulate rental or investment property. If the 'Guru' was acting as your agent, then they may have a fiduciary duty to you. But if they are acting merely as a seller, then they may or may not have an obligation to you. A real estate attorney should review your contract to determine legal responsibility and available legal remedies against the 'Guru,' if any.
