"In so-called plea bargaining, prosecutors threaten unduly severe sentences for those defendants who dare go to trial."

As criminal defense attorneys, we see this all too often. Many defendants who want to have a trial choose to plead guilty simply because the threat of increased charges and sentences is just too big of a risk. This hardly feels fair in a system designed to allow a jury of peers to decide if guilt has been proven.

If the 250th anniversary of American independence invites reflection on our foundational values, this issue deserves a place near the center.

A new state law goes into effect on Aug. 1 in Minnesota, which will no longer allow 10-, 11- and 12-year-old children to be prosecuted. Instead, children under 13 who are considered delinquent, or who have broken a state law, will be redirected to social services.

The Minnesota Association of County Social Service Administrators represents social service staff across the state's 87 counties and is asking the state to step in and make changes to the law.
