McKeen & Associates attorney and Executive Committee Chair Kenneth Lee recently obtained a $1 million dollar settlement in a case involving the delay in diagnosis and treatment of an embolic stroke. The patient, a 44 year-old woman who was recovering in the hospital from a hysterectomy and oophorectomy surgery, began demonstrating subtle signs of a stroke on the day after surgery. The stroke was not recognized by the providers for several hours, and by that time, the patient was no longer a candidate to undergo a mechanical thrombectomy surgery to remove the clot that caused the stroke. Although the case was aggressively defended by the Defendant Hospital, Attorney Lee was able to establish in multiple depositions that various providers were negligent in failing to understand and appreciate that the patient had several risk factors for stroke, and that those risk factors were all known, or should have been known by the Defendants, which should have led to much earlier recognition and treatment of the stroke.
