📢 USCIS Update: A Second Lottery for H-1B CAP FY 2024 was run!

In March 2023, USCIS conducted the initial random selection for the fiscal year (FY) 2024 H-1B cap, including beneficiaries eligible for the advanced degree exemption. Only those with selected registrations are eligible to file H-1B cap-subject petitions. The filing period for selected registrations was from April 1 to June 30, 2023.

🔜 Now, USCIS has conducted a second selection process to fill FY 2024 numerical allocations. Additional registrations were randomly chosen from the previously submitted electronic registrations.

🗓 Once completed, USCIS will notify all prospective petitioners with selected registrations, granting them eligibility to file an H-1B cap-subject petition for the beneficiary named in the selected registration.

📧 Those selected will have their myUSCIS accounts updated with a selection notice, containing important details on when and where to file.

✅ If selected in this second lottery for this H-1B fiscal year, USCIS must receive the full H-1B petition between 08/02/2023 and 10/31/2023.

🌍 F-1 students, don't forget your annual vacation! After completing a school year, talk to your designated school official (DSO) to confirm your eligibility and get your Form I-20 signed if you plan to travel outside the US. If you're not eligible for vacation or taking it at a different time, ensure you enroll in a full course of study. Remember, if your program is complete, you have 60 days to leave the US, unless you're starting a new program, engaged in practical training, or on cap gap. Check with your DSO or an immigration attorney for more details. ✈️📚

Great news! The Biden-Harris Administration announced yesterday, May 1st, that they will end COVID-19 vaccination requirement for international air travelers! DHS also announced that they will start the process to end their vaccination requirements for Head Start educators, CMS-certified healthcare facilities, and certain noncitizens at the land of border. More information is expected to be released in the next couple of days.

As expected, USCIS has received enough electronic registrations to fill the H-1B numerical allocations for FY 2024 (including the master's cap). The electronic registration process, introduced during Fiscal Year (FY) 2021 has reduced paperwork, data exchange, and overall costs for petitioning employers and USCIS. This electronic lottery has resulted in a significant increase in the number of registrations submitted during the FY 2024 H-1B registration period compared to previous years. USCIS saw upward trends in FY 2022 and FY 2023 as well, with the highest registration rates in FY 2024.

If you didn't get selected in the H-1B lottery this year, don't worry! There are other visa options available such as E-2, F-1, O-1, and employment-based options like EB-1, EB-2, and EB-3. Keep exploring your options and reach out to us with any questions!
