Aaron Judge and his wife sued an interior designer over nearly $750k in alleged hidden markups and padded bills. If your remodeller, contractor, designer, or construction manager bills don’t match the contract—or prices look inflated, I can audit, find the answers, and hold them accountable. This is what I am doing in the lawsuit I filed against Conor O’Malley of Conor Design Build, where he is alleged to have fabricated miseading billings and estimates on subcontractor letterhead or using subcontractor logos.

So it turns out Kent State University and the State of Ohio have been illegally collecting old tuition from students for a decade plus when they had no right to do so, lying to multiple courts about it across the state every single time. Stealing people’s tax refunds. I’m currently looking for more witnesses to this conduct and its effects.

Folks, do you know anyone that had The Basement Guys of Cleveland finish their basement? Anyone that was promised a "proprietary" or "unique" system or the "Everlast Wall Panel" system? I'd love to talk to them to find out what was installed by TBG in their basement. Especially looking for folks who had basements finished by them in the past 2 years. Want to see what they were told and what they got to see if it matched up or not. Looking for potential witnesses in a pending case.

Myers Law is donating $500 to the Twinsburg City School District to use in the purchase of asthma inhalers for Wilcox Primary School students and other District school students. Twinsburg recently implemented a program to purchase, stock, and administer asthma inhalers for students having asthma attacks at Wilcox. Wilcox is a school for students in Pre-K, Kindergarten, and First Grade.

This is an important issue to Dan Myers; his children take daily asthma medication. “This is a crucial program to protect students’ lives and health,” said Myers.

This program is especially helpful for children who have asthma but no diagnosis or symptoms at this point. “Many families deal with childhood asthma, but some parents don’t know their children have it until they suffer an attack. For families who don’t know their children have asthma, this program could be the difference between life and death,” said Myers.

Even for children with an asthma diagnosis, this program can be essential. When children experience an asthma attack, immediate access to an inhaler is necessary to keep them alive and breathing. “Families have lost children because an inhaler was locked up too far from where the child is having an attack. I thank Twinsburg Schools for following through with its promise last year to implement this program and make inhalers available when needed,” Myers said.

The District stated in an email to Myers that it is exploring implementing this program at other District schools, as well. Under an Ohio law, schools are empowered to buy, stock, administer inhalers, and accept donations for buying them, to protect students and workers in the case of an asthma attack.

It was great catching up with classmates and colleagues at the CSU College of Law Alumni Association Annual Recognition Luncheon. We celebrated two excellent figures in the legal community, Judge Deborah Turner (who has an amazing backstory for how she came to her position and this career), and Frank Gallucci (an amazing and dedicated plaintiff’s advocate).

Huge consumer news today, folks: with the dismissal of the Beder v. Cerha Kitchen and Bath Design Studio, LLC appeal, and with the Ohio Supreme Court's decision yesterday not to accept the Estate of Tomlinson v. Mega Pools appeal on the consumer law issues, Ohio law just became clearer and better for consumers. By not taking up the consumer law issues, the Ohio Supreme Court allows an appeals court decision to stand that held that remodeling an existing home is not the construction of a residence, and that the construction of a new pool is not the construction of a residence, either. Because of that, Ohio consumers have stronger rights and better remedies under an older, and stronger, consumer law. The Beder and Tomlinson decisions both found that Ohio's newer (and worse) Home Construction Service Supplier's Act only applies to the construction of a residence, not to remodeling of a residence, or pool installations, so your rights as an Ohio consumer remain intact, and your remedies remain large (3x actual economic damages) under the Consumer Sales Practices Act. This is a rare, great day to be a consumer.

Why choose Myers Law? Dan Myers actually shows up to court on time when a conference is set. Unlike some opposing attorneys who forget about court dates and waste everyone’s time. When so much of success is simply showing up, get someone that will show up. And save the rest of us, that do show up, the headache.
