⚖️ Cryptocurrency Seizure and the BTC-e Case Update (1:25-cv-02085)

🪙 We recently received a call from some Argentine BTC-e victims and realized there’s some confusion about the recovery process, starting with the difference between civil and criminal forfeiture.

In this particular case, there was a criminal forfeiture, but since Alexander Vinnik was surrendered to Russia in a prisoner swap for Marc Fogel, a U.S. Citizen, the criminal charges were dropped against Mr. Vinnik.

After the dismissal, a civil forfeiture against the cryptocurrency was filed in California, and was either moved or dismissed and refiled in the D.C. federal court.

⏰ It appears that potential victims can file a claim as of July 4th of this year, which is when the civil forfeiture case was initiated by the Government. Also, there may be an avenue for relief via the MLARS division of the Department of Justice.

Common sense tells a potential victim that both avenues for relief (either a claim or administrative relief) should be pursued. This information is not offered as legal advice.

It is not a crime to carry more than $10,000, but it is a federal offense not to declare currency or monetary instruments totaling $10,000 or more to a CBP officer upon entry or exit from the U.S. or to conceal it with intent to evade reporting requirements.

Last week, Hidalgo CBP officers discovered U.S. currency totaling $815,475 hidden within the vehicle of a US citizen.CBP officers seized the currency and the vehicle. Homeland Security Investigations special agents initiated a criminal investigation.
