Watching a parent slow down is one of the hardest things a family goes through. 💙

And if the time ever comes when they can't manage their finances or make medical decisions on their own - the last thing you want is to be fighting it out in a Texas courtroom.

Here's something a lot of families don't realize until it's too late:

If your parent doesn't have a Power of Attorney in place, and they become incapacitated, you can't just step in and handle things for them. Even as their child. Even with the best intentions.

Instead, you'd have to petition a Texas judge for something called Guardianship - a legal process that can take months to complete and cost thousands of dollars in court and attorney fees. The court decides who gets control. Not your family.

A Power of Attorney changes all of that.

With a POA, your parent gets to choose - right now, while they're healthy - who they trust to help manage their finances, make medical decisions, and handle day-to-day life if they ever need it. It's their choice. Their voice. Their plan.

Having that conversation early isn't morbid. It's one of the most loving things your family can do together.

We've helped countless Texas families put simple plans in place that saved them from stress, confusion, and costly court battles down the road. We'd love to help yours too.

You've worked your entire life to build something special for your family here in Texas.

But here's something a lot of high-net-worth families don't realize until it's too late — a basic will simply isn't enough to protect a large estate.

If you own a family business, investment properties, or have substantial assets, a simple will could leave your loved ones dealing with:

❌ A lengthy, expensive public probate process
❌ Unnecessary estate tax exposure
❌ Business disruptions at the worst possible time
❌ Family financial details becoming public record

The families who protect their legacy most effectively aren't just writing wills — they're using advanced strategies like revocable living trusts, family limited partnerships, irrevocable life insurance trusts (ILITs), and charitable planning tools designed specifically for larger Texas estates.

These aren't just legal documents. They're a roadmap that keeps your wealth in your family, your business running smoothly, and your finances private — exactly the way you intended.

At Robbins Estate Law, Kyle Robbins works with Austin families and business owners every day to build estate plans that actually match the size and complexity of what they've worked so hard to build.

Because your family deserves more than a one-size-fits-all solution.

Don't leave your family's legacy to chance. Click our link to book your FREE consultation with Robbins Estate Law today — and let's build a plan as strong as the future you've already created.

Here's something I hear a lot from Texas families: "I'll just put everything in a trust so nobody can touch it."

I completely understand the impulse — you've worked hard for everything you have, and the last thing you want is a lawsuit wiping it all out.

But here's what's important to know before you do anything: Texas law is actually pretty specific about what works and what doesn't when it comes to protecting your assets.

The GOOD news first...

Texas has one of the strongest homestead exemptions in the entire country. Your primary residence? It's generally protected from most creditors under Texas law — and that's a powerful built-in protection that many families don't fully realize they already have.

Now, the part people often get wrong...

A trust is NOT a magic shield you can throw over your assets the moment a lawsuit shows up. If you're already facing a legal claim and suddenly start moving assets into a trust, Texas law has what's called "fraudulent transfer" rules that can actually unwind those moves. Courts see through it, and it can make your situation worse.

So what DOES work?

Legitimate asset protection is about planning AHEAD — before any trouble arises. A customized estate plan, put together thoughtfully and proactively, can use legal tools to help protect your family's financial future in ways that hold up.

Every family's situation is different, which is why a one-size-fits-all approach just doesn't cut it.

If you're curious about where your family stands, let's talk. A free consultation is the best first step.

Losing a parent is one of the hardest things you'll ever go through. The last thing you need is a legal maze on top of your grief.

But here's something a lot of families don't realize until it's too late: if your mom or dad lived out of state but owned a home or investment property here in Texas, their out-of-state probate court cannot automatically transfer that Texas property to you.

Yep — two different states means two different legal processes.

Here's why that matters:

✅ Texas law requires a separate, additional step called ancillary probate — filed right here in the county where the Texas property is located.

✅ Without it, the title to that home stays stuck. You can't sell it, refinance it, or officially transfer it into your name.

✅ The good news? You don't have to figure this out alone — and you don't have to fly to Texas to get it done.

At Robbins Estate Law, we help families in exactly this situation every day. We handle the Texas side of things so you can focus on what actually matters — your family.

And with our flat-fee pricing, there are no surprises. You'll know exactly what it costs upfront, from the very first conversation.

If you're dealing with a loved one's Texas property from out of state, reach out. We'd love to help make this a little easier for you.

Imagine getting a call that your aging parent collapsed and can no longer manage their finances — and you have absolutely no legal authority to help them.

This is the reality many Austin families face every year. And it's 100% preventable.

Here's what most people don't realize:

✅ A Power of Attorney (POA) is something YOUR PARENT sets up *while they're still healthy* — giving a trusted person the legal authority to handle finances, medical decisions, and more if they ever can't.

❌ A Conservatorship happens *after* capacity is already lost — meaning your family has to go through the Texas court system, fight for legal authority, and potentially wait months while bills pile up and decisions get delayed.

The difference in cost? A POA can be set up for a flat fee. A conservatorship can cost thousands of dollars in court and legal fees — plus months of stress your family really doesn't need.

We've helped countless Austin families avoid this exact situation. The conversation is simple. The protection is priceless.

Don't wait for a crisis to wish you had planned ahead.

Here's something that surprises a lot of families in Austin — you don't have to name a Texas resident as your executor.

Maybe your most trusted child lives in Colorado. Or your sibling who knows your finances best is in Georgia. The good news? That's completely fine under Texas law.

You can absolutely name an out-of-state family member as the executor of your Texas estate. There's just one simple requirement: they'll need to appoint a Texas Resident Agent.

Think of the Resident Agent as a local point of contact for the probate court — someone who can receive official legal notices here in Texas on behalf of your out-of-state executor. It's a straightforward step, and it's one we help families set up all the time.

Here's what it looks like in practice:
✅ You name your daughter in Nashville as executor
✅ She appoints a Texas Resident Agent (we can help with this)
✅ She manages the estate from wherever she is
✅ Your family gets through probate without unnecessary stress

Distance doesn't have to be a dealbreaker when it comes to honoring your wishes. The person you trust most — wherever they live — can still be the one to carry out your final plans.

We guide families through this process every day right here in Austin. If you have questions about naming an out-of-state executor or navigating Texas probate, we're happy to walk you through it — no pressure, no confusion.

Don't let distance worry you. Learn how we help out-of-state executors with a free consultation at robbinsestatelaw.com.

Your doctors follow your wishes. Your family is off the hook.

No guessing. No guilt. No impossible choices made in a moment of crisis.

It's one of the most loving things you can do for the people you care about most.

Inheriting a home in Austin should feel like a gift — not a financial headache.

But here's something a lot of families don't find out until it's too late: when you inherit a house, you may also be inheriting the debts attached to it.

Before you start planning what to do with Mom or Dad's home, here are three things you need to check right away:

1️⃣ THE MORTGAGE
Not all mortgages automatically transfer to heirs. Some loans have a "due on sale" clause — meaning the lender could demand full repayment the moment ownership changes hands. You'll want to find out whether you can assume the loan or if you need to refinance. Either way, it's manageable — but you need to know upfront.

2️⃣ UNPAID PROPERTY TAXES & HOA DUES
Austin property taxes don't disappear when someone passes away. If there are past-due balances, the taxing authority can place a lien on the home — and that lien has to be resolved before you can sell or transfer the property. The same goes for any unpaid HOA dues. These can sneak up on families fast.

3️⃣ MEDICAID RECOVERY CLAIMS
If your loved one received Medicaid benefits, the state may have a claim against the estate to recover those costs — and that can include the family home. This surprises a lot of people. The good news? There are legal strategies available during the probate process that may help protect the property. Don't panic, but don't wait either.

The bottom line: inherited property comes with fine print. Knowing what you're dealing with early gives your family the best chance to protect what your loved one worked so hard to leave behind.

Kyle Robbins has helped hundreds of Texas families navigate exactly these situations — and he'd love to help yours too.
