🚨 CRITICAL USCIS POLICY UPDATE

USCIS has updated its policy guidance, reverting to 2021 standards. Officers now have the authority to deny incomplete applications immediately, without first issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID).

What this means for you:
Margin for error has dropped to zero. Whether filing a Family Petition, Adjustment of Status, or general application, your packet must be complete with all supporting evidence on Day 1.

Take extra time to review every form and checklist before mailing your file.

A missing document could now mean a denial. ⚠️

USCIS has updated its policy on how it handles applications that are missing evidence or supporting documents.

In the past, USCIS would generally give applicants an opportunity to provide what was missing through a Request for Evidence (RFE) or, in some cases, a Notice of Intent to Deny (NOID).

Under the updated policy, that opportunity may not be required.

That means submitting an incomplete application can carry a much bigger risk than before.

Whether you're filing a Family Petition, Adjustment of Status, or another immigration application, the strength of your case starts with the packet you submit on day one.

📌 Before you file, make sure you understand:
• What evidence your case requires
• Which documents need to be included
• Whether anything is missing or inconsistent
• What could put your application at risk

USCIS recently announced a major policy update: officers now have full discretion to deny immigration benefit requests if initial evidence is missing, without issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) first.

While this may sound alarming, we saw a similar policy announced during Trump 1.0 that wasn't strictly enforced in practice. We will be closely monitoring how USCIS actually institutes this moving forward.
