AB 1482, a statewide rent control bill, just cleared the State Senate. It now returns to the Assembly. If approved, it will land on the desk of governor Gavin Newsom, who has pledged to sign it. The bill caps annual rent increases to 5% plus regional CPI or 10%, whatever is less. The new bill requires just-cause to terminate tenancy or be subject to providing a full month’s rent to tenant as Relocation assistance, regardless of tenant income. Property’s owned by REITS, corporations or LLC’s are subject to the new law. New multi-family construction will receive a 15 year waiver to encourage additional supply. Owner-occupied duplexes and small portfolio landlords of single-family homes who directly own or have held in a family trust will also be exempt. Are you a Tenant?

Did you ever want to know what the rules are for landlords in California to increase your rent?

If you are on a month to month lease, landlords in California must give you a minimum 30-day written notice to raise the rent 10% or less.

Is the increase more than 10%? They must provide you 60-days written notice.

Do you have a fixed-term lease? It's very likely your rents cannot be raised at all!

Your lease is your contract, read it carefully and know it well! You will have a better, clearer, and more professional relationship with the property owner or the property manager of your home. That equals less stress and higher accountability for all of us!

Does your rental have gas logs in the fireplace? Make sure you use a C-clamp to permanently open the damper as an SDG&E inspection will list this as a hazardous condition. This eliminates accidental damper closure and potential carbon monoxide poisoning. Having up to date smoke/CO alarms are also mandatory.
