Infections from surgical sites can sometimes occur when proper cleanliness techniques are not followed. Healthcare providers and surgeons are responsible for hand washing protocols and ensuring medical instruments remain sterile.

If these are not followed properly, they can result in prolonged recovery and more medical interventions.

The defendant breached that duty.
The breach caused the plaintiff harm.
The defendant's actions were the proximate cause of injury.
As a result of these actions, the plaintiff suffered damages.

An experienced personal injury attorney can evaluate your case and determine if there was negligence. Please give us a call for a free consultation.

We've established that there is a 2 year statute of limitations for medical malpractice cases. But are there exceptions?

There can be, under the discovery rule. For example, you went to a doctor for pain and received a diagnosis (in our example, it's a wrong diagnosis). Then, a year later, you visit another doctor and receive the correct diagnosis. Your statute of limitations would be tolled to account for that additional year.

Why do we have statute of limitations?

They exist to prevent lawsuits from being filed after relevant information no longer exists or eyewitness testimony is no longer considered reliable.

After an injury caused by medical negligence or an accident, it's best to contact a personal injury attorney quickly so that evidence for your case remains suitable for court.
