Without a will in North Carolina:

The court appoints an administrator for your estate, not someone you chose. A judge decides who raises your children.
The state's formula distributes your assets, regardless of your wishes. The process can take months to years and cost up to 10% of your estate.

A will doesn't eliminate all of that. But it gives every part of it direction, your direction.

This is one of the most common assumptions I hear.

In North Carolina, if you die without a will and you have one child, your spouse receives the first $60,000 of personal property plus half of whatever remains. Your child receives the other half.

If you have two or more children, your spouse still gets the first $60,000, but only one third of the remainder. Your children split the other two thirds equally.

Real property works differently. Your spouse receives a fractional ownership interest in the land and home alongside your children, not after them. That shared ownership can get complicated fast, especially with a family home or generational mountain land.

That's the state's plan. Not yours.

A Legacy Letter isn't a will. It isn't a trust. It won't hold up in court. But it might be the most useful thing you ever put together for your family.

It's a plain-language document that answers the questions your family will have when they need to act fast and thinking clearly is hardest:
