One question I have been asked recently is this:

If Karen Read was found not guilty by a jury, why can there still be civil lawsuits? Doesn't double jeopardy prevent that?

The answer is that double jeopardy applies to criminal cases, not civil cases.

Under the United States Constitution, a person cannot be prosecuted twice for the same criminal offense after an acquittal. That protection is known as double jeopardy.

Civil lawsuits are different. A civil case is not seeking a criminal conviction or a jail sentence. Instead, the lawsuit typically seeks monetary damages or other civil remedies. Civil cases also operate under a different burden of proof than criminal cases.

In a criminal trial, the government must prove its case beyond a reasonable doubt, which is the highest legal standard in our justice system. Civil cases generally require a much lower standard of proof.

That is why it is possible for someone to be acquitted in a criminal case and still face civil litigation arising from the same events.

Understanding the difference between criminal law and civil law is essential when following high-profile cases like this one.
