Colucci, Colucci & Marcus, P.C. secured a $1.25 million settlement for a motorcyclist who was seriously injured when an oncoming driver attempted to make a left turn in front of him, causing a severe collision.

At first, the clientโ€™s primary complaint involved an ankle injury that required casting. Months later, however, he began experiencing significant back pain. A neurosurgeon ultimately diagnosed him with a herniated disc and recommended a microdiscectomy. When that procedure failed to resolve the issue, the client later underwent a spinal fusion, which proved successful and helped him regain substantial function.

The defense argued that the clientโ€™s back condition was related to preexisting issues rather than the crash. Attorney Darin Colucci rejected multiple settlement offers, maintaining that the case was worth the full available insurance coverage of $1.25 million.

When the insurance company refused to offer the full policy amount, Plaintiffโ€™s counsel filed a 93A/176D claim alleging unfair settlement practices based on the insurerโ€™s unreasonably low offers. Shortly afterward, the insurer agreed to pay the full available policy limits.
