After the Storm: What Actually Ends Up in Dispute

Forecasters expect a below normal hurricane season this year. NOAA puts the odds of below normal activity at 55 percent, projecting 8 to 14 named storms with 3 to 6 becoming hurricanes. Last season, for the first time in a decade, no hurricane made landfall on the continental United States.

But associations that come through a difficult storm in reasonable shape are almost never the lucky ones. They are the ones that did this work in August.

Q: "Can we enforce a rule if it hasn't been enforced in years?"

A: This is a common question from boards and managers, especially when a long-standing issue suddenly becomes a priority. While inconsistent enforcement does not necessarily invalidate a rule, it can make future enforcement more challenging and, in some cases, expose the association to claims of selective enforcement.

Before taking action, boards should review their governing documents, evaluate how the rule has been enforced historically, and determine whether there have been exceptions or inconsistencies over time. If enforcement has lapsed, it may be appropriate to notify residents that the association intends to begin enforcing the rule consistently going forward.

The key is fairness and consistency. Applying rules uniformly to all owners, documenting enforcement efforts, and following the procedures outlined in the governing documents can help reduce disputes and strengthen the association's position. When questions arise about restarting enforcement of an older rule, obtaining legal guidance can help boards move forward confidently while minimizing potential risk.
