Refusing to sign does not give one spouse control over whether the divorce happens.

Once the petition is properly served, the case can proceed through the court process. If there is no response, the court may move forward without that person’s participation.

The important point is this: delay is possible, but refusal to sign does not stop a Florida divorce.

Absolutely. In Florida, you may apply for a domestic violence injunction against a current or former same-sex partner if the relationship meets the legal requirements.

The key issue is not gender. The issue is whether the relationship qualifies under Florida’s domestic violence injunction laws and whether there has been domestic violence or a legally recognized basis for protection.

If the relationship does not qualify for a domestic violence injunction, another type of injunction may still be available depending on the facts, such as dating violence, repeat violence, or stalking/cyberstalking.

A settlement agreement explains what both spouses agreed to. The final judgment is what makes the divorce legally final.

If there is ever a dispute later, the exact language in those documents can become very important. Details about property, support, parenting, and debt should be written clearly before anything is signed and entered by the court.

Child support arrears do not automatically end when a child turns 18. In Florida, unpaid support can continue to be collected until the full balance is resolved.

Falling behind can affect your property, tax refund, license renewal, and legal standing with the court.

A business started during the marriage may be treated as a marital asset in a Florida divorce.

The court may need to determine the marital value of the business, especially if it was started during the marriage or increased in value because of marital funds or labor.

If one spouse is self-employed, the business can also affect child support or alimony because income may be calculated differently under Florida law than it is for tax purposes.

Mediation gives couples the opportunity to work through divorce terms outside the courtroom, with a neutral mediator helping guide the discussion.

Assets, parenting issues, and financial terms can be addressed in a setting where both parties have a voice, instead of leaving every decision to a judge.

For couples who want a more private, practical approach to divorce, mediation may be the right place to start.

Financial control can become a serious issue early in divorce, especially when one spouse cannot access money for support or legal fees.

Florida requires full financial disclosure, but getting complete records may take court involvement, subpoenas, or temporary relief. This is one reason preparation before filing can be important, especially if you expect money to become a point of control.
